Job Applicant Privacy Notice

The present Job Applicant Privacy Notice describes the protection of personal data of prospective employees during the recruitment procedure adopted by the Company. It informs you about how we use and protect the personal information you provide to us when you apply for a position in our organization and in general when you express your interest in joining the Genekor team.

This Privacy Notice explains which information we collect during the application and recruitment process, the relevant legal basis for the processing such information, how we use the information, for how long we retain it, the rights that the job applicants have as data subjects and any other information that is required in compliance with the General Data Protection Regulation 2016/679 (hereinafter “GDPR”) and the Greek data protection legislation (hereinafter “L. 4624/2019”) as each time in force.

A separate privacy policy is in place for the Company employees, while all specialized privacy notices apply additionally to the Company’s General Privacy Policy.

By applying for any job role in our Company, you declare that you have been informed and you accept the terms of the present Privacy Notice.

WHO WE ARE

Genekor is, as per the GDPR terminology, the Data Controller when it comes to the personal data processed within the context of this Privacy Notice. This means that we are responsible to define the means and the purposes for which we process (i.e. collect retain, use and share) your personal information.

We are the Company «GENEKOR PRIVATE DIAGNOSTIC LABORATORY MEDICAL SOCIÉTÉ ANONYME», with registered address at Gerakas, Attica, referred to hereinafter as «Genekor», an emerging multinational company specializing in Molecular Biology and Genetic tests.

WHICH PERSONAL DATA CONCERNING YOU WE COLLECT AND WHAT IS THEIR SOURCE

Genekor is committed to protecting the privacy and security of your personal information. The term Personal Data describes information which, alone or in combination with other information available to the Company can be used to identify you.

Personal information that may be obtained or produced by us during the recruitment process (either when you reply to a job ad and you send your cv to us or during your interview) can include-but is not limited to:

  • name, surname, date of birth, home address, e-mail, phone number or other contact details
  • education, previous and/or related professional experience, foreign language skills, other qualifications, talents, or other any information you may provide in order to support your job application.
  • Information regarding any previous applications or work history you might have with Genekor
  • Other personal information mentioned in your cv and/or your cover letter.
  • Information from your LinkedIn profile (if you refer to your LinkedIn profile in your cv or your application).
  • Information from interviews and selection procedures in which you may have participated.
  • Details on the type of job you are currently seeking, your current and/or desired salary and other employment terms relating to employment fees, and benefits
  • Any other specific category of sensitive and/or demographic information obtained during the application or recruitment process, such as age, information on your nationality and/or citizenship, medical or other health information.
  • Reference letters including information provided by third parties upon your previous consent.

HOW WE PROCESS YOUR PERSONAL INFORMATION

We process your personal data, to the extent permitted by applicable law for the following purposes:

  • Evaluation of your skills, qualifications and interests in relation to the employment requirements of our Company and your suitability for the specific job role for which you are applying.
  • Verification of your information
  • Examination of any objections to non-hiring you might submit
  • Confirmation of recommendations upon your prior consent
  • Communication with you regarding the recruitment procedure and/or your applications (s), as well as any potential future career opportunities in our Company
  • Compliance of our Company with applicable laws and regulations or protection of Genekor’s legitimate interests (e.g. to defend the Company against any legal claims)

If the recruitment process is successful and we make a job offer, you will receive notice of the Privacy Policy for the Personal Data of Employees. The Privacy Policy in question includes all relevant information as well as the legal basis under which we will process your personal data during your employment.

LEGAL BASIS OF PROCESSING

According to GDPR, data processing must be performed under a specific legal basis, ie an actual purpose to collect, store, use and disclose your personal information.

The processing of your personal information is mainly necessary in order to assess whether an employment contract will be concluded and is based on Article 6(1) (b) of the GDPR and the relevant provisions of the Greek data protection legislation which regulates the employment relationships or the time period prior to its conclusion.

In addition, Genekor has a legitimate business interest under Article 6 (1) (f) of GDPR to process personal data during the recruitment process and to keep records of such processing in order to employ only people who are most suitable and eligible for a specific job role. Processing your personal data during the recruitment process is necessary in order to assess and verify the suitability of a job applicant and to decide to whom to offer the job.

Finally, in some cases, we need to process data to ensure that we comply with our legal obligations or to respond to and defend legal claims (Article 6(1)(c) of GDPR) of if we have received a consent to this end (Article 6(1)(a) of GDPR).

TO WHOM WE DISCLOSE YOUR PERSONAL DATA

Your personal data is being shared internally within our Organization between the different departments as part of our process of selecting candidates in order to be employed by the Company. This internal disclosure is being done in a secure way and always on a need to know basis. Genekor’s personnel is always subject to confidentiality obligations by entering into specific Non-Disclosure Agreements.

We may also share and receive your personal data from third parties, individuals or legal persons such as for e.g. recruitment agencies.

In addition, your personal information may be provided by our Company to a third-party operating on our behalf, in order to provide any of the aforementioned services (e.g. performance of qualifications assessment). Such service providers are considered our “data processors” and they also have a legal obligation under GDPR and towards Genekor to protect your personal data and use it only to provide the agreed services.

In some cases, where we share your data as a data controller with another data controller, the use of your information by such other Organization will be subject to the organization’s own privacy policy. Genekor makes every effort to select partners who provide high quality, reliability, trust, protection and security services, but it is not responsible for the use your personal information by these third-party Organizations. These partners may use your personal information in order to contact you directly.

Especially at the recruitment stage, your personal information may also be disclosed to third-parties, such as accounting service providers, employment agencies, insurance services or other organizations and regulatory authorities if we are required to do so under the applicable law by virtue of Article 6(1)(c) of GDPR.

Exceppt in the above cases, your information will not be transferred or discloses to third-parties for marketing or other purposes.

TRANSFER OF PERSONAL DATA TO OTHER COUNTRIES

Your personal information is usually not being transferred outside the European Economic Area. In the event of such need, and if the transfer concerns countries which have not been approved by the European Commission as having adequate legal protection of personal data, we will take all necessary measures to ensure adequate protection of your information such as entering into appropriate data transfer agreements based on Standard Contractual, approved by the European Commission, as provided in article 46 par 5 of GDPR or other adequate measures.

DATA ACCURACY AND YOUR RESPONSIBILITIES

It is important that the personal information we hold about you is always accurate and up to date. For this reason, please inform us as soon as possible if any of your information changes or is incorrent during the recruitment process.

FOR HOW LONG DO WE RETAIN YOUR PERSONAL DATA

We will retain your personal data for the following periods:

  • Candidates who were interviewed: if you have been interviewed, your personal information, which will include additional information such as interview notes and any other information provided by you during the interview, will be kept for up to 6 months since the last contact we had with you.
  • Rejected Candidates: if your application has already been rejected at the initial stages of the process, your data will be retained for up to 2 months from the receipt of your initial application.

Genekor may retain anonymized data- that is, data that allows you to be identified- for statistical purposes or to improve your recruitment procedures.

YOUR RIGHTS

By virtue of the Regulation, you have the following rights:

  • To be informed about the processing of your personal information. This is the purpose of the present Notice.
  • To rectify or to obtain from us the rectification of your personal data if they are inaccurate or to complete them if they are incomplete.
  • To object to the processing of your personal data
  • To restrict the processing of your personal information
  • To delete your personal data („right to be forgotten”) in certain cases if there is no legal reason to continue processing
  • To move, copy or transfer your personal information („data portability”)
  • To inform, question or even oppose any automated decisions made in relation to you, including profiling
  • To request access to your personal information and information on how we process it
  • To revoke at any time any consent you have given to the processing of personal data with effect from the moment of revocation and thereafter (the legality of any prior processing is not affected
